CAO’s attempt disgusting

I find it absolutely disgusting that El Dorado County’s CAO Terri Daily and Assistant CAO Kim Kerr are trying to claw back the health retirement benefits promised to retirees of El Dorado County. Several ex-county employees stood up nearly in tears at the Board of Supervisors meeting Tuesday describing how they have cancer and other ailments requiring treatment and can’t afford to pay for the CAO’s screw up. These are ex-county employees that were forced out in early retirement and promised medical benefits as part of their early retirement benefit package. They were given a deal and the county should abide by the deal.

This $500,000-plus insurance mistake was caused by the county’s executive management and more specifically, Kim Kerr. Isn’t Kim Kerr’s background and expertise insurance and risk management? Why didn’t Kim explain the real root cause of the problem to the Board of Supervisors and public as County Auditor Joe Harn, CPA requested in his e-mail of April 21? There seemed to be no personal accountability.

The mistake happened 23 months ago at around the same time Kim Kerr began her employment with El Dorado County. Among Kim Kerr’s many past titles of expertise, she also claims to have been a military staff sergeant, coroner investigator, deputy CAO and city manager. Kim Kerr’s “Jack of all Trades” mentality and master at none is becoming like a dull 14-tool Swiss Army Knife — totally useless and costly! For those of you who haven’t read the City of Ione mayor’s letter responding to the Amador County Grand Jury regarding Kim Kerr’s former conduct in Ione, it is enlightening and no wonder these screw ups are occurring in El Dorado County now.

I wonder how our CAOs would like their salaries and benefits clawed back? I find this treatment of ex-county employees, many who could be classified as elderly, absolutely appalling and disgusting!

    Jack: What you report, if true, is indeed appalling, disgusting and unconscionable. Over the past year there has been considerable comment about the CAO's office, with particular reference to Kim Kerr and the 2011-2012 Amador County Grand Jury Report. From a September 2012 article by Chris Daley: ”The Grand Jury finds that on many occasions the city manager provided insufficient or misleading information, making it difficult or impossible for the City Council to cast intelligent votes.” And, the “city manager for the fiscal period 2007-2011 did not demonstrate that she possessed the proper qualifications and expertise to perform the duties required for that position.” So ………….. a logical question arises: Why do EDC and BOS apparently not care about any of this? At yesterday’s BOS meeting an Ione resident cared sufficiently to make a public request for information. The video segment of his request and input can be found HERE at 00:48:35 minutes.

    GRAND JURY FINDINGS AND RECOMMENDATIONS Finding #1: The City Manager for the fiscal period 2007-2011 did not demonstrate that she possessed the proper qualifications and expertise to perform the duties required for that position. (Facts #1 -3) Agree. The City is working closely with both the Amador County Counsel and with the Amador District Attorney to determine what, if any, action should be taken against former City Manager Kerr. "Finding #2: The General Plan created by the City Manager and consulting firm PMC was unrealistic based on the financial infrastructure in place at the time. (Fact #3) Disagree. On August 26, 2009, the City adopted a new General Plan. As described on page 1-2 of the General Plan, the Plan is "a long-range planning document that provides the City a policy framework for land-use planning based on the City's long-term vision for growth. The General Plan contains the community's desires and visions of lone through 2030 and beyond. The General Plan was not drafted only by former City Manager Kim Kerr and the contract City Planner, PMC, but was created through an extensive dialogue with residents of the City of lone via workshops at both the Planning Commission and City Council levels.     Jack DuffyIn June 2011 Kim Kerr took the assistant chief administrative officer position with El Dorado County, ~23 months ago. You say the “mistake” happened 23 months ago. Jack, you seem to be laying blame for the mistake at the feet of a new hire. Do you REALLY believe that a new hire can author, review, and implement such a “mistake” while she is still in an orientation phase? Kim Kerr is guilty of being an economic adviser to a municipality during the 2008 crash. She is found to have offered bad information to Ione city fathers during that time (LINK - Doh!)The City fathers made bad decisions during a time of economic collapse. (Doh!) How about this, Jack. Kim Kerr is a scapegoat via GJ investigation for Ione’s city fathers. The GJ’s conclusions are a Homer Simpson, “Doh!”.

Community advisory boards are cultural--economic socialism. Marketing for tourism does not work Ione broke. Sustainability--next economy--new economy...is breaking down America--one place at a time. But when you say, “I think is it important to hire people who already have skills and knowledge in a plan then I think you are saying that EDC should have chosen from within existing staff. They did not. They chose a person whose only “crime” was having been Ione City Father’s scapegoat. The GJ report says Kerr lacked the ability to predict, forecast and advise during the 2008 collapse. Well, Doh! Had Kim Kerr possessed said qualities The GJ refers to she would not have been in the employment of Ione. She would be in the company of people such as LINK - John Paulson. Ione’s city fathers used the GJ system to CYA. Kim Kerr was hired 23 months ago. The “mistake” was made 23 months ago. Kim Kerr was not the “mistake”. Kim Kerr did not author, vet, review or implement the “mistake”. Kim Kerr is a scapegoat. Doh!

    Evelyn--sorry went to the town...I had seen another article like your link...then this one...http://www.redwoodcurtaincopwatch.net/taxonomy/term/5039...there was another where she was defending the use of pepper spray in a court case--some people were trying to sue the county. Also Phil--when Ms Kerr worked in Solano county--they were already into the sustainability ideas--backed by Davis. I could get links for that as well. Again I dont know if Ms Kerr is guilty of any thing...but she knows the wording of the general plans and the idea of sustainability. Now for giggles--maybe looking at governments that have been using these advisory groups across the USA vs Grand Juries would be fun...public money being given away and used for personal satisfaction? ...no...personal gain--I guess it is what that person or persons "need."

    Evelyn, the story from Humboldt County’s improper termination of FRANK FRITZ is indeed sad . . . pathetic even. But Kim Kerr DID NOT initiate that improper termination. Public Works Director, Allen Campbell initiated that termination sequence. County General Services Director Kim Kerr, was simply doing her job in the failed attempt to support Campbell’s termination of Fritz by hiring a detective to support the termination. Ms Kerr is not the villain here. You guys are really making a toxic brew by tossing Agenda 21, sustainability, Ione’s GJ report and Kim Kerr into the scandal blender. It all seems to have begun when Ms Kerr did not react in a warm, fuzzy and accepting manner when Melody Lane ambushed her last year at Denny’s. Melody doesn’t like Kim. BFD!

During a previous Jury report, I personally delivered five banker boxes to the jury’s hired auditor. On my last day as city manager, all of my e-mails records, documents and files were also secured for jury review. I cannot speculate as to why they did not want any comment or clarification from me personally.”

    I dont even know Kim Kerr...and no one is playing by the rules. The BOS just gave away 350,000. To people who were not elected. These words that people are using go across the world. And cities counties and states are going under. I know of Ray more than Kim--I live in Pollock--and links would look bad for him. Santiago has been using the sustainable plans for a long time...so IF you can find a good link--put it up. Im looking.

    If I recall correctly, the pepper spray Q-Tips were applied to the eyes of the protesters. But, of course, it was humane?? Oh, really? Those who think it's humane should give it a try -- it's torture and strange those who torture always feel it's humane. As in, I do bad things, but I'm really a good person because it was humane. And, Frances, her being an alleged vet gives her no mitigation regarding Q-Tips. Eight years in the Military Police on her vita -- interesting. Wonder what time frame?

    Evelyn...you just want Phil to be mad at me. Okay--how I read it is that two officers were heavy handed...and left the area. Kerr also left Humbolt--and went to work in Ione. At this point the author is saying Kerr asked these two officers to come back and work in Ione.

    MEANWHILE returning to the core of Jack Duffy’s premise we see, "The “mistake” happened 23 months ago . . . “ Kim Kerr was hired 23 months ago. Therefore Kim Kerr made the mistake. To support this assertion various elements of Kim Kerr’s past are brought into the argument. Kim Kerr made a “mistake” in El Dorado County because mistakes were made in Humboldt County where she worked. Mistakes were made in Ione where she worked. She was well trained in the art of mistake making and on her very first day of employment with El Dorado County she drew on her mistake making skills honed sharp in Humboldt and Ione and made a mistake in El Dorado County and Kim Kerr now wants to claw back her mistake and if she does not succeed in clawing back her mistake she will call in pepper spraying SWAT teams to torture you and then shoot you. Do I have it right so far fair citizens of Salem?

    This is a newsletter broadcast group for the case of the Pepper Spray Eight, Humboldt County California Headwaters Forest Defenders who were subjected to pepper spray torture by sheriff's deputies and Eureka City Police in three incidents in September and October of 1997. In an unprecedented use of pepper spray in this way, the red pepper concentrate was applied with Q-tips to the eyes of the protesters while they were engaged in civil disobedience sit-ins with their arms locked together inside metal pipes. In some cases, the pepper spray swabbing was repeated a second time, and in three cases the noxious substance was sprayed directly into the protesters' eyes from only inches away. The protesters filed a federal civil rights lawsuit in 1997, and after two mistrials with hung juries in 1998 and 2004 got a unanimous jury verdict in their favor in U.S. District Court in San Francisco, California on April 28, 2005. Background: In 1997, nine nonviolent activists sued the Humboldt County Sheriff and the Eureka Chief of Police for violation of their Fourth Amendment right to be free of unlawful search and seizure due to excessive force. The first trial in 1998 ended with a 4-4 split jury, but instead of granting a new trial, the judge threw the case out. A series of appeals overturned the judge's ruling and removed him from the case for the appearance of bias. A second trial took place in September 2004, resulting in a hung jury split 6-2 in plaintiffs favor. A third trial in April 2005 produced a unanimous verdict in favor of plaintiffs, finding that the direct application of pepper spray on nonviolent protesters by Humboldt and Eureka officers was unconstitutional excessive force. However, Jack Duffy legitimately asked: "Why didn’t Kim explain the real root cause of the problem to the Board of Supervisors and public ... ? As the BOS video for 4/23/2013 shows, Kerr was tasked with handling the particular agenda item.

As described on page 1-2 of the General Plan, the Plan is "a long-range planning document that provides the City a policy framework for land-use planning based on the City's long-term vision for growth. The General Plan contains the community's desires and visions of lone through 2030 and beyond. The General Plan was not drafted only by former City Manager Kim Kerr and the contract City Planner, PMC, but was created through an extensive dialogue with residents of the City of lone via workshops at both the Planning Commission and City Council levels. The General Plan helps to achieve the community's vision by setting Goals, Policies, and Actions to "preserve lone's history and create a viable and flourishing community that current and future generations will be glad to call home." (These are sustainability issues that our county is now doing.)

    OK, OK, I know you all want to know how I would handle protesters locking arms in a government building. First, when a subordinate suggests the Q-Tip/pepper spray/eyeball approach, I would ask him if he was nuts and that I would be keeping my eyeballs on him in the future. Here's my solution, do nothing and wait. After several hours some would quit to go to the bathroom. Others who are hardcore would persist, but after a day or two without water they would just collapse. Mission completed, no torture or liability. And why are they called Q-Tips? Simple, Quality Tips. Yes, it's true.

There is a Grand Jury need to look into this mess if a new panel can be found that is ready to get to work, the hiring and background of Kerr will be a top of the list investigation. Why a person with a background of questionable ability and conduct was hired needs a thorough review.

    Phil--Just to set the record straight about Kim Kerr, you should know that the incident you referred to at Denny's took place early last year during the Taxpayers Assn. meeting when Kim Kerr was the guest speaker. The Amador County Grand Jury report had just come out, so I took the liberty of quoting a few excerpts from the 2 year investigation into Ms. Kerr. The question I posed to Kim caused Bernard Carlson--not Ms. Kerr--to explode in a finger-wagging fury. However Kim maintained her composure and addressed my pop-question. I might add that I have no ill feelings towards Kim. In fact, we've met with Kim, Terri Daley and Supervisor Briggs on more than one occasion regarding issues that are a concern to all citizens, namely TRANSPARENCY AND ACCOUNTABILITY. When the inquiries hit too close to home, that's when I presume County Counsel advises our government representatives plead the 5th. Anything they say can & will be used against them...all in good time.

    Phil et al: For the record, Compass2Truth is a watchdog organization. The purpose of a good watchdog is to sound the alarm. The CAO issues in Jack Duffy's letter are cause for ALL citizens to be justifiably concerned. The Kerr-CAO matter was first brought to my attention in May 2011 via a reliable source (quote from email): "If you go to the website, Ionepd.com, and see for yourself what the City Manager, Kim Kerr did to that small city of Ione. I was working there when she was hired. I watched how she fired many employees and hired her good friends from her former city position. It is a disgrace how she ruled with an iron fist and bankrupt that city. She is under multiple investigations from the grand jury to see if there are any criminal complaints. She is moving on to a new position in El Dorado County. I don't know if you can find out what department is actually hiring, but if you can, the department should be advised if she is in any high level financial decision making position. What she did to Ione is very similar to what happened in Bell, California. The city of Ione is basically bankrupt after her four years as Ione City Manager." The truth will prevail. Unfortunately EDC citizens will eventually pay dearly via costly litigation for yet another GOB scandal.

Demo didn't publish the Amador-GJ-Kerr debacle until 3 months AFTER I popped the GJ question during the Denny's Taxpayers meeting when a member of the EDC GJ was present: http://www.mtdemocrat.com/news/amador-county-grand-jury-report-rips-kim-kerr/ Now fast forward to January 14, 2012 when Terri Dal and Kim Kerr again were the guest speakers at the Taxpayers Assn. This time County lawyer & Taxpayers President Al Hamilton created a scene when I attempted to address a question to Daly and Kerr. Before I could get the question out of my mouth, Hamilton interrupted, announced his dictatorship and abruptly adjourned the meeting...all in the presence of 3 EDC supervisors. Kerr immediately approached me and I must say she handled herself in a dignified manner (damage control). It was obvious to everyone Hamilton had orchestrated the unprecedented scene. Lots of issues still need to be addressed, but so far no response to 2 formal Notice & Demands does not bode well for EDC leadership, transparency or accountability. California's oldest newspaper has a golden opportunity for a scoop story...if only publisher Esposito would return multiple requests to meet in person.

A well only produces so-much water. We have reached that point where baby-boomers are retiring from the public sector and are set to consume the greatest amount of healthcare of their entire lives. The math simply does not work. The point about, "they were given a deal and the county should abide by that deal", is the belief in Santa Claus. They were given a deal that benefited those offering the deal. It provided them with power, money and votes. I know you all think I am nuts, but the promised benny's to millions across this country were nothing more than a Greek horse. Watch what happens in Stockton.

For their unwavering and unquestioning support of Kim Kerr and her financial follies. For not understanding the budget crisis in the face of dozens and dozens of public comments and public presentations at City Council meetings warning them of this pending (and rather predictable) financial crash. For allowing the financial standing of Ione to be misrepresented (feel free to substitute ‘lied about’ or ‘covered up’ or ‘distorted’) to the public week after week. For allowing Kim Kerr to get away with intentionally inflating and misappropriating budgetary figures (and feel free to substitute ‘cooking the books’ or ‘defrauding’ or ‘deceiving’ or ‘conning’)to rationalize her senseless spending sprees.     The Grand Jury has no duty or obligation to solicit explanations from suspected wrong-doers. People can be called to testify as part of the process, but it is no way should be judged in any way as innocent people that were not chosen to testify and for the GJ to not have found wrong doing by not seeking an opinion of the wrongdoer, many times the evidence speaks for itself.

They have driven away many of the longtime staff with institutional knowledge and relevant professional credentials only to seek to demote them or replace them with out-of-towners with no institutional knowledge and often devoid of the proper professional credentials and experience.

    Arens property by Crystal view is up for sale...this looks out at the view that subway does in Pollock...another logger out of work. They also owned Los Hermonos--that every one missed--but didnt go to enough to support it. The group that wants their "restaurant" or Rec. store--didnt win because family dollar store paid huge fees to go in. I hope no one tries to interfere with that family getting the "best" price for those few acres.

I remember the Logan Building!" - HERE: Pioneer Plaza with over 30 years of deferred maintenance, lacks enough parking, not nearly ADA compliant, no elevator, etc., etc. Can’t wait to see the County’s final price tag on this one after all the true bills come in, especially since it is meant only to temporarily house workers during county remodeling. Why did Russ Fackrell lie to the Board of Supervisors and tell them the building was 40% vacant when it is really nearly 100% occupied? Yep, sounds like a real winner to temporarily house employees with a multi-million price tag.

It read: "Chief Administrative Office, Facilities Division, recommending the Board consider the following: 1) Authorize the Chair to sign the Purchase and Sale Agreement and Joint Escrow Instructions (PSA) No. 571-01311 with the owners of Assessor's Parcel No. 323-400-231 for purchase of a building for purposes of consolidation of leased facilities and needs related to deferred maintenance; and 2) Authorize an escrow deposit of $35,000." As pointed out HERE: This major acquisition was hidden from public view by never referring to its name Pioneer Plaza or its address at 344 Placerville Drive. This is a departure from the rule that agendas should be sufficiently specific so that the public knows what's being talked about.

    Additional tsk tsk - The County appears to have been taxing the property based on an appraised value of LINK -$2,183,094 Yet the County only paid $1,750,000.00 for the property. Will the prior owner receive a property tax refund? And . . . now that the property is off the tax role, who's gonna make up the difference? DAMN! And who got the -$433,094 difference . . . KIM??? hmmm

    NO. Websites and Agendas differ. That the particular case under discussion is a departure from practice can be confirmed by studying prior BOS agendas involving property transactions.

Does this become part of the county ala the fairgrounds and the county government complex? Cuzn Phil is correct to point out the GJ recommendation.
