Dear Director Stanton and General Manager Cahill,
At the October board meeting Director Neibauer made a request for a more detailed general manager’s monthly report and both of you denied her request. I have now asked both of you several times to show me the documents that allowed your actions. I haven’t heard back with anything fulfilling my request. I take your silence as an admission that you have no legal basis for your actions at the October board meeting. If I am wrong I will gladly review any documentation that you can provide or go to any Website and read where you have the right to deny Director Neibauer’s request.
I, on the other hand, have referred you to documentation that prohibits the actions you took against Director Neibauer at that board meeting. Director Stanton, I have referred you to section 4040.1 and 4050.3 in the Cameron Park Policy handbook. Also the general manager’s report action is “receive and file.” How can you legally compel a vote on an item when the action on that item does not include a vote? This is highly irregular and perhaps a violation of the government code. In the general manager’s case I have referred her to her job description, bullet point six on page one, and to her employment contract. I point this out again because it seems that both of you are asserting your right to deny Director Neibauer’s request based on the “we can do what we want so nanny nanny boo boo stick your head in do do” system of governance.
I have spent a great deal of time going over the California Government Code and I haven’t found the section that supports the above system of governance that you two are asserting. If the above system of governance exists could you please refer me to the section of the government code that it is in? What I want from both of you ASAP is either that you show me the documents that allow your behavior or contact Director Neibauer and inform her that her request for the more detailed monthly general manager’s report that she requested will be forth effective in November.
You see, Director Stanton and General Manager Cahill, neither of you get to make up the rules as you go along. Neither of you get to make up rules that suit your own needs and ends. Therefore, provide your legal justification for your denial of Director Neibauer’s request or provide her with the meetings matrix that she requested. You have no other choice if you wish to remain law-abiding representatives of this district.
