The purpose of the Second Amendment is to arm people in order to prevent future tyranny. They need the tools to do this.

The term "Well Regulated" in the Second Amendment meant "Well Manned and Equipped " in 1791 as was determined in the 1939 United States v. Miller case after referencing the autobiography of Benjamin Franklin. The concept of Government Regulation, as we understand it today, did not exist at the time.

United States v. Miller also determined that the term "Arms" refers to "Ordinary Military Weapons" (not crew operated). American Citizens have the right to Keep and Bear, which means Own and Carry, any weapons that a soldier carries into battle. That includes past, present and future weapons. A Militia consisted of armed volunteers willing to fight with their personal arms and not under government control.

The 2008 Heller v. Washington DC decision reaffirmed that the Right to Bear Arms was an Individual right. The 2010 McDonald v. Chicago decision reaffirmed it yet again and made it clear that it applies to every state, every city and every town in the United States.

To limit the Second Amendment to muskets would be the equivalent of limiting the First Amendment to writings in quill pens.

Liberty is worth the risk of death!

Wake up: It's really easy for those that haven't been personally been affected by gun tragedy to want less strict gun control. Until you are personally affected by a completely preventable death of a child by a gun, you really don't have a clue! People please wake up! Look at the statistics and you will see the states with stricter gun laws such as New York have much less crime and accidental deaths by guns. It's common sense!

Re: Sheriff's Letter to the Vice President.
All too often the issues of crime and crime prevention get lost in the emotions of those people that are for or against gun control. Thank you Sheriff D'Agostini for writing and making public a non-emotional and clearly stated letter regarding this issue. You are entirely correct in stating that mental illness and antisocial behavior are the real problem behind violent crime. More importantly, it is critical to our nation that our leaders not bypass the constitution to force their desires on its citizens.

Very clear case of political posturing when someone stands or moves in a way that they hope will make other people notice and admire them. This clearly is the case of EDC Sheriff John D'Agostini. Who recently used his office to support the Guns and Roses fund raising event in El Dorado County on behalf of the California Gun Owners Association. And now writes to the Vice Presidents of the United States portraying mental illness, not guns as the root cause of gun violence in America, mimicking both the NRA and Republican Congressman McClintock.

Vice President Joe Biden
The White House
1600 Pennsylvania Avenue NW
Washington DC 20501

Dear Mr. Vice President,

I am elected Sheriff of El Dorado County, California and as such I am sworn to support and defend the Constitution of the United States and the Constitution of the state of California against all enemies, foreign and domestic. I was also elected by the people of El Dorado County to manage and direct the 358 employees of the El Dorado County Sheriff's Office. As a leader, I take my oath of office seriously and in doing so; set an example to those I lead.

My agency's Mission Statement reads as follows:
The mission of the El Dorado County Sheriff's Office is to uphold the law through the investigation and enforcement of criminal and civil law, top provide leadership and law enforcement support to allied enforcement agencies, to deliver consistent and humane treatment to those placed in our care and custody and to perform these responsibilities in a manner that is responsive to the needs of our community and faithful to the Constitution of the United States and the Constitution of the State of California.
As you can see, the United States Constitution, the foundation of our liberties, that we are both sworn to support and defend, is the crux of our duty and honor we owe to all we serve and lead.

The purpose of this letter is to go on record of re-affirming my oath of office and making it clear that I and my staff will never violate that oath by being pressured into enforcing any unconstitutional provision, law, or executive order.

It is well known and proven with facts, not emotional interference, that gun control of any kind, has no effect on reduction of crime, anywhere. If all manner of firearms were removed from within the borders of the United States those in society would who have no respect for the rule of law, would still find a way to obtain and use firearms. This is an absolute fact given the current laws we have in this nation and in California that ban possession by felons and prohibited classes yet law enforcement continues to encounter the aforementioned individuals in possession of firearms.

Our Nation's problem with violent crime is not an issue of firearms; it is an issue of mental illness and antisocial behavior. If as much efforts were expended in keeping criminals out of our communities and identifying and treating our mentally ill are are expended in the folly of gun control, this Nation would experience an immensely measurable decrease in violent crime.

My agency will continue to support and defend the Constitutional rights of all we serve, without any mental reservations or purposes of evasion.

Respectfully,
(SIGNED)

More than likely, the gun buying frenzy that Obama, Cuomo and DiFi (hereafter known as OC&D) have set off has brought generated interest in gun ownership amongst people who have had no exposure to them in the past, and thus don't know the first thing about them. Training, training, training. Before OC&D go on another sales campaign, they should emphasize safety first. Of course, these kinds of accidents only play into their hands. -Don't know why there would have been a loaded gun at a gun show that was not tucked snugly into a holster. Someone's definitely got some 'splainin to do. somehow, the NRA must be to blame...

Point made, James. I made sure my sons attended gun safety classes before they ever owned a gun. The NRA sponsored safety classes in the past. But after hearing that five people were shot at these "Gun Shows" I wonder: Is the NRA more busy taking $$$ from the gun manufacturers than pushing SAFETY 1st? and were there ANY "real" (responsible) gun owners around?

Dink, If you don't like the NRA, cancel your alleged membership. And if you don't like Fox news, don't watch it. But, is okay with you and all the other gun-phobes and lefties if I keep my NRA membership? Will you allow me the freedom to watch Fox News if I so choose? (Whether or not I do watch it is not the point-I don't have a TV and I don't watch internet video news, I read). Just askin'

NRA has done MORE for the Gun manufactures in the last 10-years and done NOTHING for their members.
George, this is the kind of talk that drives these folks batty. To know that Feinstein did more to hype and promote the "assault rifle", and that Obama has done more to promote gun and ammo sales than any politician in history makes them seethe. They couldn't leave well enough alone, and now they're reaping the rewards of their ill-fated efforts. It's kind of funny really. While Smith & Wesson, Sturm Ruger, Colt, and Springfield Armory are obviously pro-2nd Amendment, Obama has most certainly been responsible for the most profitable months these companies have ever seen. But alas, the majority of Americans have very short attention spans and are easily distracted by shiny things and the WalMart sale catalog, so this too shall pass. Maybe by summertime a new diversion will come along and America will resume her course, although MUCH more heavily armed :^)
