Rebecca Smith, one of two nurses charged with elder abuse after a patient in their care died, appeared briefly in court Thursday morning to accept a plea agreement.
Smith, who appeared alongside attorney Guy Louie, pleaded no contest to the first count against her, elder or dependent adult abuse, between Feb. 23, 2008 and March 6, 2008.
After Louie and Deputy Attorney General Steven Muni approached the bench for a minute, Judge Douglas C. Phimister announced that sentencing would take place on Jan. 23 at 9 a.m. After an inquiry from Muni, Phimister told Smith to contact the probation department before she left as they would need to accommodate her needs of living out of state.
Donna Palmer, the other nurse, will appear in Department 2 on Nov. 9.
The charges against Palmer and Smith came as a result of the death of Johnnie Esco, who died as a result of fecal impaction in 2008 while under the care of the nurses at El Dorado Convalescent Hospital in Placerville.
